These Website Terms of Use and Terms of Sale ("Terms") are an agreement between you and Cochran Cyber Education LLC ("CCE," "we," "us," or "our"). They apply to cceplayer.com, CCE Player downloads, exam-pack purchases, product pages, support services, and related online services.
By using the website, downloading CCE Player, or purchasing an exam pack, you agree to these Terms. The CCE Player End User License Agreement ("EULA"), Refund Policy, License, Updates, and Support Policy, Privacy Policy, and Exam Preparation and Trademark Disclaimer are incorporated into these Terms by reference.
1. Eligibility and customer information
You must be legally able to enter a binding agreement. If you purchase or use a product on behalf of an organization, you represent that you have authority to bind that organization. You agree to provide accurate checkout, license, and support information and to keep your license key and download access secure.
2. Products
CCE Player is a free software application used to open and study compatible CCE exam packs. Paid exam packs are licensed digital educational products. Product-page descriptions identify the certification exam code or version, tier, included materials, price, and applicable system requirements.
Product screenshots and feature descriptions are illustrative. We may correct typographical errors and update product descriptions, but a correction will not reduce rights already granted for a completed purchase.
3. Orders, payment, taxes, and delivery
Lemon Squeezy acts as merchant of record for paid purchases. Lemon Squeezy processes payment, calculates and collects applicable transaction taxes, issues receipts, and administers payment-related obligations under its terms. The customer may see Lemon Squeezy's name or its applicable statement descriptor on the payment statement.
Prices are shown at checkout before purchase. A purchase is complete after payment is authorized and the order is confirmed. Digital delivery may occur through a receipt email, customer portal, license key, download link, or CCE account or entitlement service.
You are responsible for providing a working email address and checking spam or junk folders. Contact support@cceplayer.com if an order is paid but delivery or activation does not work.
4. License and device limit
A purchase grants a personal, limited, nonexclusive, nontransferable, non-sublicensable license to use the purchased exam pack under the EULA. Unless a product page expressly states otherwise:
- The license belongs to one purchaser or one specifically licensed user.
- The purchased pack may be activated on no more than two customer-controlled devices at the same time.
- The two activations are for the same licensed user and do not authorize account, key, or pack sharing with another person.
- The license may not be resold, rented, published, uploaded, distributed, or used to operate a shared question bank, training service, classroom, or commercial testing service.
Separate instructor, classroom, institution, or enterprise rights require a separate written license from CCE.
5. Updates and continued use
Each exam-pack purchase includes content corrections, additions, and refreshed pack releases for 160 calendar days beginning on the purchase date.
After the 160-day period:
- You may continue using the last pack version for which you were eligible, subject to the license terms.
- You may redownload that last eligible version while CCE continues to make it available through the normal delivery system.
- Later content releases are not included unless you purchase an extension or another entitlement.
A new or replacement certification exam code, a substantially revised certification exam, or a separately identified new product is not an included update. CCE Player security, compatibility, and bug-fix updates remain free and are not limited to the 160-day exam-pack update period.
6. Activation changes and replacement devices
You may deactivate a licensed device through available self-service controls. If a device is lost, damaged, replaced, or inaccessible, contact support for assistance. CCE may limit automated reset frequency to protect against license sharing, but may grant additional reasonable resets for legitimate circumstances.
Circumventing activation controls, submitting false reset requests, or repeatedly rotating devices to share a license is prohibited.
7. Refunds
Eligible purchases are covered by the CCE 30-Day Money-Back Guarantee described in the Refund Policy. Refund requests must be submitted within 30 calendar days after purchase. The Refund Policy includes protections against duplicate satisfaction refunds, license sharing, fraud, and repeated purchase-and-refund abuse. Lemon Squeezy may also issue refunds or handle chargebacks under its merchant-of-record obligations.
8. Acceptable use
You may not:
- Violate law or the rights of another person.
- Share, sell, publish, distribute, or provide unauthorized access to a license key, exam pack, question, answer, explanation, image, or other CCE content.
- Remove copyright, trademark, license, attribution, or security notices.
- Circumvent licensing, encryption, update-entitlement, download, or device controls.
- Reverse engineer, decompile, disassemble, modify, or create derivative works from CCE software or protected pack formats except to the limited extent applicable law expressly permits despite this restriction.
- Use automated extraction, scraping, screen capture, optical recognition, or similar methods to reproduce or build a competing question bank from CCE content.
- Introduce malicious code, probe systems without authorization, disrupt the Services, or attempt unauthorized access.
- Use CCE products to obtain, reproduce, distribute, solicit, or teach confidential live certification-exam content.
9. Intellectual property
CCE Player, exam packs, practice questions, explanations, graphics, branding, website content, software, pack formats, and related materials are owned by CCE or its licensors and are protected by applicable intellectual-property laws. Except for the limited licenses expressly granted, no rights are transferred to you.
Certification-provider names and marks belong to their respective owners. Their appearance identifies the certification for which independent study materials are intended; it does not indicate sponsorship, authorization, affiliation, or endorsement.
10. Educational-product disclaimer
CCE provides independent educational practice materials. CCE is not a certification-awarding body and does not control certification exams, exam objectives, scheduling, scoring, candidate rules, or retirement dates. CCE does not guarantee that a product is error-free or that any customer will pass an exam, obtain a certification, gain employment, earn a promotion, or achieve any other outcome.
Customers remain responsible for consulting the certification provider's current objectives, candidate agreement, exam policies, prerequisites, and scheduling information.
11. Availability and changes
We may maintain, update, replace, suspend, or discontinue parts of the website or online Services. We will use reasonable efforts to preserve the perpetual-use and last-eligible-version rights described in these Terms, but temporary outages, security events, third-party failures, or circumstances beyond our reasonable control may affect online availability.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Services and products are provided "as is" and "as available." CCE disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted availability, compatibility with every device or configuration, or any particular certification or career result. This section does not exclude warranties or rights that applicable law does not permit us to exclude.
13. Limitation of liability
To the maximum extent permitted by law, CCE and its owners, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business opportunity, certification fees, or goodwill arising from or related to the Services or products.
To the maximum extent permitted by law, CCE's aggregate liability arising from or related to a paid product will not exceed the amount you paid for that product during the 12 months before the event giving rise to the claim. For free Services, aggregate liability will not exceed 25 U.S. dollars. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
14. Suspension and termination
CCE may suspend delivery, updates, or activation access when reasonably necessary to investigate fraud, chargebacks, security threats, license sharing, or material violations of these Terms. CCE may terminate a license for a material breach that is not cured after reasonable notice when a cure is appropriate. Upon termination for breach, use of the affected product must stop and copies must be deleted. Provisions that by their nature should survive termination remain in effect.
15. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Before filing a claim, you and CCE agree to make a good-faith effort for at least 30 days to resolve the dispute informally by contacting support@cceplayer.com. Unless applicable law requires otherwise, legal proceedings must be brought in a state or federal court with jurisdiction in or over Canyon County, Idaho.
Nothing in these Terms limits any nonwaivable consumer right or prevents either party from seeking appropriate relief in small-claims court where eligible.
16. Changes to these Terms
We may update these Terms prospectively. The revised version will be posted with a new effective date. A change will not retroactively reduce a customer's paid license, eligible update period, or last-eligible-version rights for an existing purchase unless required by law or agreed by the customer.
17. General terms
If part of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms or a license without CCE's written consent. CCE may transfer these Terms as part of a merger, reorganization, sale of assets, or similar business transaction. These Terms and the incorporated policies are the complete agreement regarding the matters they cover.
