This End User License Agreement ("EULA") is a legal agreement between you and Cochran Cyber Education LLC ("CCE") for CCE Player, CCE exam packs, accompanying documentation, and related updates (collectively, the "Software and Content"). By installing, opening, activating, or using the Software and Content, you accept this EULA. If you do not agree, do not install or use it.
1. Ownership
The Software and Content are licensed, not sold. CCE and its licensors retain all right, title, and interest in CCE Player, exam packs, practice questions, explanations, graphics, protected formats, documentation, updates, and associated intellectual property. This EULA grants limited use rights only.
2. CCE Player license
Subject to this EULA, CCE grants you a personal, limited, revocable, nonexclusive, nontransferable, and non-sublicensable license to install and use CCE Player on compatible devices you control. CCE Player is free; paid exam packs are licensed separately.
3. Exam-pack license
For each validly purchased exam-pack license, CCE grants one licensed user a personal, limited, nonexclusive, nontransferable, and non-sublicensable license to use that pack on no more than two customer-controlled devices at the same time.
The two-device allowance is for the same licensed user. It does not authorize sharing a license key, activation, pack, question bank, or content with family members, classmates, students, coworkers, customers, or any other person.
4. Permitted backup
You may retain one reasonable backup copy solely to restore your own lawfully licensed use. A backup remains subject to this EULA and may not be shared, published, or used to avoid activation or update-entitlement controls.
5. Restrictions
Except to the limited extent applicable law expressly permits despite these restrictions, you may not:
- Copy, reproduce, publish, upload, distribute, sell, rent, lease, sublicense, lend, or transfer the Software and Content.
- Share a license key, customer account, download link, activation, exam pack, question, answer, explanation, or screenshot containing protected content.
- Reverse engineer, decompile, disassemble, translate, modify, adapt, or create derivative works from CCE Player, an exam pack, encryption, licensing logic, or a protected file format.
- Bypass, disable, interfere with, or misrepresent activation, encryption, device, download, or update-entitlement controls.
- Use scraping, automation, screen capture, optical character recognition, model training, data extraction, or similar techniques to reproduce or build a dataset, question bank, course, application, or competing product from CCE content.
- Remove or alter copyright, trademark, attribution, license, security, or ownership notices.
- Use a personal license for a classroom, lab, library, shared workstation pool, commercial training service, or service bureau.
- Use the Software and Content in connection with unauthorized confidential live exam content or activity that violates a certification provider's candidate agreement.
6. Activation and privacy
Paid exam packs may require online activation and periodic validation. CCE may process limited order, entitlement, installation, device-recognition, compatibility, and security information as described in the Privacy Policy. Device recognition should use a protected one-way fingerprint instead of retaining raw hardware identifiers.
You agree not to provide false activation information or misuse reset procedures. Ordinary device replacement and legitimate support resets are handled under the License, Updates, Devices, and Support Policy.
7. Updates
Exam-pack content updates are included for 160 calendar days from purchase. After that period, you may continue using the last version for which you were eligible. A replacement certification exam code or separately identified new product is not an included update. CCE Player security, compatibility, and bug-fix updates remain free.
Updates may add, change, or remove features when reasonably necessary for compatibility, accuracy, licensing, or security. CCE will not intentionally use an update to retroactively eliminate a customer's last-eligible-version license rights.
8. Third-party components
CCE Player may contain third-party or open-source components governed by separate notices or licenses. Those licenses control the applicable components. Nothing in this EULA reduces rights granted under an applicable open-source license.
9. Feedback
If you voluntarily provide product suggestions or feedback, you grant CCE a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation. This does not transfer ownership of your personal information or confidential materials unrelated to the feedback.
10. Termination
This EULA continues until terminated. You may terminate it by stopping use and deleting the Software and Content. CCE may suspend or terminate an affected license for a material violation, fraud, chargeback, unlawful distribution, or intentional circumvention of technical controls. Where appropriate, CCE will provide reasonable notice and an opportunity to cure.
Upon termination, you must stop using and delete the affected Software and Content. Ownership, restrictions, warranty disclaimers, liability limits, and other provisions that should naturally survive remain in effect.
11. No certification guarantee
The Software and Content are independent study aids. CCE does not warrant that they contain every topic that may appear on an exam or that use will result in a passing score, certification, job, promotion, or other outcome. Certification providers may change objectives, policies, and exams without notice to CCE.
12. Warranty disclaimer
To the maximum extent permitted by law, the Software and Content are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted operation, or error-free content. Nonwaivable statutory warranties and consumer rights remain unaffected.
13. Limitation of liability
To the maximum extent permitted by law, CCE and its owners, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, business opportunity, certification fees, or goodwill.
To the maximum extent permitted by law, aggregate liability relating to a paid exam pack will not exceed the amount paid for that pack during the 12 months before the event giving rise to the claim. Aggregate liability relating solely to free CCE Player will not exceed 25 U.S. dollars. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
14. Export and legal compliance
You may not use, export, or transfer the Software and Content in violation of applicable law. You are responsible for compliance with laws and certification-provider agreements applicable to your use.
15. Governing law
This EULA is governed by Idaho law, without regard to conflict-of-law rules. The informal-resolution and forum provisions in the Website Terms apply. Nonwaivable consumer rights remain unaffected.
